I would not have bothered to help this kind of customer at all, even as a reseller. Some people are just not worth the time.

A lot of lawyers will write whatever you want them to write. They're charging you after all. If you lose your bullshit argument it doesn't matter to them.

I'm no expert...But isn't this fraud? Since he willfully misrepresented information on a legal document for personal gain?

No, I think the world would be a lot better place if people had to be 100% accurate when doing these communications. People write whatever they want to write. Fraud will only become a thing if you're entering into a contract of some sort.

See if the Attorney is real or if they did send the letter, If not then forward the letter to the local Law Society. Its a criminal offence to impersonate a officer of the court. If a am not mistaken the penalty is up to 8 years imprisonment.

I do not think the law has any grounds for this exchange, as you said, its a classified sale therefore voetstoots sale, unless you invoiced him?
I am not sure if the lappy was new or not, kinda browsed, but under consumers act, second hand or used goods are not protected under the consumers act.
If it was a new laptop, than he shouldnt have minded a refund or exchange, its not rocket science.
The fact that you went out of your way to help beyond and infinity says something.
I mean you even offered to do all the shipping at your expense, and its not like you have negative ratings and such.
Customers are just full of shit to put it bluntly.
I think that guy is going to be missing for quite awhile. The lawyers fees probably costed more than the laptop.

Be very careful when you shout VOETSTOETS. It only covers patent defects. To top it off if you can prove a latent(hidden) defect then it's the one time in our civil law where the onus of proof is reversed. It's really not applied or relied on much nowadays but you can be in for a shock if you want to be all legal like. I personally don't believe the Letter of Demand is real.

I think it is. In fact it is a Letter of Demand. I can demand anything. But just because I demand something, doesn't mean it's legal or right.
A Letter of Demand is just a step in the legal system. You cannot just take someone to civil court, you have to first allow to rectify the situation before it goes to court.

Secondly I think the mods should just ignore this thread. It is posted in the Smacktalk section. Once it escalates to a Bad Deal thread, then they are more than welcome to intervene.

I meant to say really from an Attorney. Basically the consult alone would be in the region of R800 to R1000 plus the cost of drafting. Then to top it off it was sent by email not registered post as would be required by the rules of court. Only way to waive this rule of service is if it was part of a written contract.

But hey I have not seen the letter so can't comment.

itrader changed. I think it'll be very hard for him to get people to deal with him now that he has two bad itraders

Where there are legal disputes between 2 parties, it would be unethical for the one party, to send a letter his lawyer drafted . Instead your lawyer should be asking who is legally representing your opposition and contact them to avoid this back and forth waste of internet space ... They will address the facts and relay whether you actually have a case or just blowing smoke to take it forward.

Lawyers are manwhores ( no offence Ian xD ) they will do what you ask them to the best of their ability :p
