Phones are seriously damaged. Seller giving me the silent treatment.

TLDR
: Phones were advertised as being in Perfect condition with 1 year warranty remaining. They arrived with deeply scratched screens, damaged edges and the one has a cracked back (I can relate). Samsung said the phones are so seriously damaged that the warranties are voided on both. I have offered several reasonable and very accommodating solutions but the seller is just ignoring me flat.

Full story: I asked @Nooblar if he would be comfortable shipping first considering our respective feedback scores. He declined with the following: "fully aware i have been on carbonite for a long time just havent done many deals, and from my side im not going to take the risk as i have seen cases where people have done over 100 successful deals and hit bad times and gone down. Thats why i prefer my deals to take place in person and only after a few of those do i start trusting people take Zak - Typhon i have probably bought 10 laptops from him but only the one deal via carbonite and then we continued doing business together off forum.

But basically i wont ship without receiving the funds and if that takes a bit longer because i have to sell it to a local carbonite user then i am happy with that"

I verified this with @Typhon who said that they had in fact done business a few times without any issues. I asked @Nooblar for some pictures of the phones just to make extra sure it is not a scam of some sort and from the pictures it seemed very legit as he had pictures of his kids on the wallpapers and everything. He explained that the phones were always in covers with screen protectors and when the screen protectors started to show signed of wear he would replace them. I did not have any reason to think that he would straight-up lie so I did not inspect the photos properly for signs of damage. That was my mistake. Everything seemed 100% legit so I was comfortable with paying first., which I did at around 14:00 on 23 February 2023. He sent the package with the phones in later the same day via Postnet.

At about 16:40 on 27 February 2023 I went to collect the phones from Postnet. I only got around to opening the package the next morning in front of @Bedeker Snyman . When I took out the Green S22 Ultra I immediately noticed a bunch of scratches around the edge of the phone and deep scratches on the screen. With the Burgundy S22 Ultra I immediately noticed the back was cracked from a fall on the corner without a cover. The screen on the burgundy one was also scratches but slightly less. and not as deep. On 28 February at 06:52 I notified @Nooblar of this. He immediately responded asking for pictures and saying that he did not see any issues with the phone. I struggle to believe this as the damage is very obvious and I noticed it nearly immediately. If he and his wife were using the phones every day there is no way they would not notice the scratches on the screen. The crack on the back from the corner is also very clear in person. I went back the pictures he sent me earlier and sure enough, if you know what to look for you can see the crack was already there. The damage on the rest of both phones are also clearly from regular use without covers or screen protectors. At that stage I was still willing to believe that he somehow honestly missed all the damage, but considering the course of action he has now decided on, I highly doubt it.

I asked for a refund. He was very apologetic and asked for a day or two to get enough money for the refund. Keep in mind that his reason for selling was that he replaced both phones with S23 Ultra's. I requested a partial refund so long which he ignored. The next day I followed up on him to no avail. On 3 March I made the suggestion that he just refund me R7k as a discount for the damage (which is very generous considering that is what it would cost to get only one phone repaired). He responded by saying that he remembers paying for Samsung Care and that he would look for those receipts as it would allow for Samsung to repair the damaged screens and back cover for free. I left him to enjoy his weekend and gave him enough time to look for those receipts.

On 6 March I followed up but no response. On 7 March I followed up again and he responded saying he actually did not know what I needed from him before I can go to Samsung (implying that he did not look for anything in the meantime). I asked him to email me the proof of purchase for the phones along with a receipt for the Samsung Care. At 14:12 on the same day he said he was tired and would send it the next morning. On 8 March I followed up with no response from him. On 9 March at 13:01 he sent a photo of the receipt for the phones but no receipt for the Samsung Care. I thought it might be registered on the serial numbers or something so first thing on 10 March I went to the Samsung Service Centre in Hillcrest, Pretoria.

The technician at Samsung had a look at the phones and said that the Burgundy S22 Ultra's warranty was voided by the impact damage as evidenced from the cracked back and knock on the corner. The Green one's warranty was voided due to how deep the damage on the screen is. So no more warranty as advertised. They also said that depending on the Samsung Care contract, I would maybe have to budget an extra few bucks for the back cover on the Burgundy as it might not be covered. But either way they would need the Samsung Care contract before they could do anything. I immediately informed @Nooblar of this and asked for a refund. I offered to help him with the repair of the phones by taking it back to the Service Centre if he sent me the contract, which would save him the hassle of having to sort it out from Margate. I even sent him the details on how he could get a copy of his Samsung Care contract sent to him. But I still wanted my refund. Those messages got blue ticked.

Since then he has not replied to any of my several follow-up messages, nor picked up any of my calls. On 17 March at 08:12, I made another offer to get the deal sorted out in a manner that I think was very accommodating to him and I informed him that failing a response I would escalate the matter:
"Man I really want to get this sorted out. I don't actually want a S23 Ultra since it is too expensive for me, hence I bought the S22 Ultras from you. But just to get this sorted I'll make you the following offer which I think is really in your favour at this point. I see brand new S23 Ultras going for R20k in Marketplace and Carb so I might be able to sell it for that much. Send me one of the S23 Ultra phones (in perfect condition) you bought along with R3100 as that is the fair cash difference from our deal and then I can send you back the S22 Ultras. Then you aren't left without a phone and you can deal with them however you choose and it only costs you R3100 out of pocket.

If you are able to just refund the full amount you can consider it an interest-free loan and we call it a day. I'd prefer this.

I feel like I've been very accommodating and tried to come up with several solutions but you are just avoiding me and taking no responsibility so my patience is wearing thin on this. Please answer me by 12:30PM today otherwise I am forced to escalate the matter"

I tried to phone a couple times again but no answer. I haven't been blocked and he is still posting stories on Whatsapp of all the fun he is having so he definitely is just ignoring me. At this point I just want my money back and he can consider any other offers rescinded.
