Advice - WeBuyCars damaged the car during a test drive

Don't get why she didn't go with him during the test drive?

When I sold my swift, I told them the car doesn't leave me sight so I went with them on the drive and they do push it to ensure they ain't buying a heap of junk

I'm no expert, but I would assume they would be liable if they buy a car and it conks out.

Webuycars may be scummy, but you cant expect them to sell a lemon. What if the next person drives the car hard and it breaks? Whos liable to sort that out?
Spoke to a secondhand car parts dealer about this the other day.

WBC actually get around this with regards to the CPA in that they label the car sale as an Auction - AFAIU that means you can do to the car whatever you want, including test drive, but the moment you "buy" the car and drive it off the floor, they are no longer liable for anything that happens to it - yes, the engine can literally blow up 100m out the door and they will wash their hands of it.
That's why you never buy from them (unless you are an absolute expert in the particular vehicle and able to inspect it fully, then there are some bargains to be had)

Its unfortunate for sure, but its entirely your fault. Ignorance is not the same as innocence and you should have known the buyer would need to push that car to a limit that is considered acceptable.

My advice for the future would be to make sure the item you are selling is at least in a working condition before trying to sell it such. That car, although somewhat functional, was broken and you probably should have listed it as scrap, or returned it to a working state before selling it. Trying your luck is on you and you should accept responsibility for it instead of trying to dump it on a third party. GL.
