GPU not in condition advertised

First time doing this so hope i got it right, didn't want to tried to work it out with seller but getting ghosted now!

Description of Bad Deal:
I purchased a P104 for MR-N3G on 16 Sept 2019, card was stated as "Condition: Great not really used " and in PM "They did update the hiveOS with eth pill but in that time i have not used it. Its been gathering dust in storage. It ran for about a week. Il try and see if i can set it up for you. "
(So condition is great and only used for about a week)

We agreed on the following as i've never heard of the card(only knew the P106)
terms are Price 1300 shipped
7day warranty
Eth mining above 45mh as you(seller) say it does close to 50

If you happy then its fine

On receiving the card 19 Sept i pmed and whatsapped the seller the following

Hi i just picked up your card, there are a few issues
1-Packaging was really bad, no box or anything to protect card, just some bubble wrap, which leads to point 2
2- Bracket bend, either in transit due to packaging or it was like that when you shipped it
3- you stated that the card is in great condition and hardly used(about a week), this card has being used,lots of corrosion on screws and bracket plate, please take a look at the pics
4-what setting were you using as tested it at stock at 37 and best i can get is 41 with 300core and 1800Mem?

To date i have received no response on carb from the gent and on whatsapp only 3 reply's first saying "it sat in storage and i did not see any rust on card and can i test it", it still worked so replied to the guy and got a thumb up, no im sorry about this and lets work it out or anything

On 20th Explained the issue again and asked for a full refund or that he refund a portion of amount and i will risk it on this card as i would like to play with it and condition is very poor and not like you advertised and only got a responce send me a screen shot
that was at 12:55 on the 20th, since then no response

Ive tried to work this out with him but getting ghosted now!

@Mr-N3G , you have until midday to respond. I sent you a whatsapp to come online and check this thread and you have chose not to read it even though you were online. This means you have no intention to sort this out, as such i do not see why you should be on carb.
