Advice Needed. Phone seller blacklisted and now phone doesn't work

My sister worked for a large Insurer, bought a salvage phone and had the screen replaced. And then discovered that the Iphone she bought was blacklisted. Here's the thing the guy that claimed had stopped paying about 4 months before he claimed so he broke it to get a new phone from them knowing full well it was blacklisted
Despite her company providing proof etc, Cell C flat out refused to unblock the phone. So its a Ipod now.
 
You can sell something you don't own you can never transfer ownership but you can sell.

Vodacom undertook to provide service to that phone for the price per month. That phone is connected to the Sellers name not yours. So when he sells it to you then don't pay them you get screwed since now you don't get the service anymore. The sale by vadacom was never just the phone but the service or providing thereof as well.

They wont take the phone from you even if ownership still resides with them. U will just bring spoliation to get it back.

You need to take this guy to Small Claims since the phone u bought to use a certain way is now a paper weight

Anyway i am moeg so i think thats what i remember from contract law might be so wrong
 
Theres another thread on here where something similar happened to me and someone else except the guy was running it as a business on a larger scale. Even after producing an original invoice to the network we were basically told to f-off (after they said they'd consider it if we could produce invoice and we spent a considerable amount of time looking for it and scanning etc).

Replaced the board at a repair place for around R1500 but this was an S3 not iPhone 6.
 
Always call vodacare to check IMEI ,furthermore they can check whether the phone was on contract or cash purpose they using morpheus and icap system ...

My sincerest apologies mate, it really wasn't my intention to make your thread a joke. Your concern and trouble is valid and actually quite serious (and a threat many people on the forum face). Good luck, I hope it gets sorted in some way or another.

Thanks for the input. I need to be better at checking out phones in future.

Small claims seems like such a lengthy and costly process for a phone.

I would hope that [MENTION=405]Boss[/MENTION] does the right thing and contacts me .

There is software you can use to unlock blacklisted iPhones.

Try searching the jailbreaking forums (Although jailbreaking itself will not unlock it), but there are add-on software that can definitely unlock your phone to accept bands from network carriers.

Nope it should be neither

All you pay for is the Summons costs that's it - No attorneys allowed so its just you and him and the judicial Officer (Attorney registered to do the matter)

You will need all the correspondence between you to prove the contract of sale under misrepresentation :) He misrepresented that he can transfer ownership with all the (Voordele) of ownership yet he could not.

like on an android device where you flashed it with odin and a new os.
would that then unlock the phone?

No, the IMEI code is basically placed on a network blacklist, so first you'll have to find out if the IMEI code is blocked, on which network it's blocked ans then pay for it to be unblocked.
 
Interesting thread. I learnt a lot - basically never buy a second-hand phone...maybe the seller is ANOTHER person with an addiction problem?
 
The phone may work outside SA border sometimes example swazi lesotho,maputo ....

Let this be a painful lesson that you can spare yourself if buying 2nd hand.

Or only buy after person has upgraded to new phone.
 
So what's the correct proCedure to ensure that a future blacklisting doesn't affect Yor phone purchased seCond hand?
