Marius1404 - Please do not deal with this individual

Morning all

So i have been putting off posting this thread in the hopes of having the problems with the deal i did with [MENTION=28367]Marius1404[/MENTION] , now a month and a half ago.

So here is the story:

I bought a MSI Z77 G43 (http://carbonite.co.za/f39/motherboard-cpu-ram-127229/) from him and all was good till i received the board and found there was an issue with the USB.
After back and forth messages and promises to send couriers or a friend to collect the board from me, i just requested a refund and i would ship the board back to him once i received payment.

This has now been going on for almost 2 weeks and when i ask what is going on, i get a reply saying sorry things are rough on his side but he will do it later.

Now i understand that everyone has issues and that things don't go according to plan but communication is key.

So i am advising everyone not to have anything to do with this guy as i don't want people to be in the same boat.
 
Yet he got a positive iTrader from you? Or was the issue only discovered a bit later?
 
Yeah I'm in a similar situation with another guy who needs to refund me. It's been going on for almost 8 months now and he keeps saying that he doesn't have a job so can't pay me back. Only recently discovered that he is still buying gpus, screens etc.

Well he has this last month as he now "finally has a job" to pay me back. Will see what transpires but I think I'll have to name, shame and get him banned. Funny thing is that I had a very good and successful deal with him once before.

I powered the board on and checked it, didn't have time to do a full test but was happy then and gave him a positive rating.
Need to change that now.

Ah, makes sense. Yeah I've done it before as well, but it's stopped completely now. I'll thoroughly test before giving iTraders.

Looks like [MENTION=28367]Marius1404[/MENTION]'s last activity was the 17th of last month. I don't even do many deals and even I check in more frequently.

I hope he sorts you out but looking at that I have a feeling he has done a hit n run.

I agree. Has now started ignoring my messages as well.
One thing he did do, which was a lil bit silly was email me from his work email.
Anyway will give him till the end of the week and then consider taking things further.
 
Tell him that you're going to pull his boss into this, see how fast things change. It's a real dick move, but it works.

That's BS Fox. Should have named and shamed him after the first month at the latest to be honest, can't let someone mess you around for that long, no matter who he is or what he's rep / itrader is.
 
Is there not some kind of CPA on second hand goods? If you sell something defective you must refund in x days? A nice carb user bought my AMD card earlier this year, that R9 270 that only works on my system lol and I refunded him. But yeah also bought a Intel board earlier this year that has a dead LAN port, but did not bug the seller about it, just went the WIFI route. :)
 
Well apparently he has serious money issues but yes, there should be something in place.

Believe there is, but the CPA only applies if this is during your normal line of work. In other words, if you are a second-hand salesperson, it applies, if this is a private deal, it doesn't.

As far as I know, if the buyer requests a refund within 14 days after purchase in a private sale, he is entitled to his/her money back. Correct me if I am wrong, think its consumer protection act or something. If he has not offered you a swapout or money back, it could go to court if he does not come through. Few years back a mate of mine did the same and actually won. He bought a phone and found out the camera was not working the next day. It was not mentioned in the sale, so he won the case.
 
Again, the Consumer Protection Act applies to businesses of which you are a consumer, not to private sales/trades, as neither in that case is called a "consumer".
 
CPA will not apply for secondhand goods unless it is your business selling secondhand goods. In a private capacity, CPA means sweet fuck all.

Doesn't that only apply to vehicles? I know when I sold one of my vehicles out of hand, I typed up a list of all known faults and the buyer and I both signed it.. I think that rule is only valid for 6 months as well.

Incorrect. The cpa has nothing todo with pvt to pvt sales. Its purely between consumers or consumers and pvt person

When you are selling a secondhand vehicle not sure what else it applies to but specifically a second hand vehicle the buyer buys it as is the only stipulation according to the Cpa is that the seller has to inform the buyer of any known defect

No you are wrong, it only applies to when the Seller is a Dealer not between private persons. [MENTION=508]SilvRav[/MENTION] is correct...

You are also confusing the common law warranty against latent defects with the CPA. That still applies to private deals.. If you say you did your research I suggest starting with the CPA itself.
