So long story short, I wrote off my car and the insurance isn't paying out because of technicality. I don't have much knowledge when it comes to these things and need some help. Can this be fixed for not too much (+/- R100k and up) ? If not, where can I go to sell it?

Wow - that's quite some damage - hope nobody got too hurt.

Have you perhaps thought about salvage places like SMD?
 
@Gurshick to be honest, I'm extremely desperate, I haven't went to look at the car yet, but I was told that if the chassis isn't bent, it can be done
 
First off let me just say, im glad that you are ok and that you are still here to post about the ordeal.
I hope you get well and recover quickly from your injuries

Secondly - as mentioned above try get the places like SMD or scrapyards to buy it from you.
Just dont expect to get much from them as they will pay peanuts for the car.

Jeez dude. That is some scary shit. To walk away from an accident like that. I rolled my car like a rally champ in 2009, it wasnt THAT fucked, but pretty wrecked, sold it to a guy in Vereeniging for like R25k - he fixed it up and sold it again for probably close to R80k. Unfortunately I dont have his number anymore :/
 
What was the technicality?

Making an assumption - but was it speed? That's some excessive damage. Going to be hard to repair.

The money going into the repair and the resale of the car afterwards. Eish fok

@SubLoaded @VeloABF16v I was listed as a "Disallowed Driver" on the policy, hence why they're not paying out. And I wasn't planning on selling it after the repair, would want to keep it as I'm still paying of the car
 
Selling for parts usually come to a better price. But obviously (as carb has shown) its much more of a hassle. We tried that route first after my accident, but takers were far and few ;/ maybe an ST would have better luck. Especially if that engine is somehow reparable.

Is the car and insurance registered on your name?

Are you the primary driver or at least listed as a secondary?

No open driver policy?

Eish - what a kak situation. Pay more for insurance next time. Expensive school fees this...

As the policy of my previous car was on my mom's name, I asked her to see if she could do the same for this car and she said she'll find out, she then told me that she could do it and that it's sorted out. After the investigation, the insurance told us that they told my mom that they would not pay out if I get in an accident or anything like that as I'm going to be listed as a disallowed driver, and she apparently said it's fine

Also a speedy recovery from my side bud, see my post looks abit harsh. Imo I really wouldn't repair that as it will alway have some sort of issues and sqeeks and and, but good luck in your quest, hope you get a good outcome.

@Gurshick Not a problem at all, I know it's a shot in a dark, but I truly loved this car and would do anything to have it back. I tried looking for others, even if it's older models, but can't find anything in my budget

I would certainly request a record of this conversation that was had with your mom. Might have been an agent error or agent purposefully misleading the uninformed.
 
@virus786 I have requested it but haven't received anything yet, but I spoke to my broker and she informed me that my mom did agree to that

Balls. Get the recording of the conversation. If your mom had said that it was fine, surely she had confirmation of the cover in order to do so? Why was a policy number given out, and insurance premiums being debited if this wasn't the case?

The scenario here is that your mother is the policy holder and you are the nominated/secondary driver. The only time, based on the situation, for non-payout should be if the insurance is on her name, and she is listed as the main driver (most KMS/use of the car) and they are able to prove that you actually make use of the car more than she does.
 
Maybe @janhendriklaufs is still a young lad so the insurance company wouldn't appreciate him driving such a vehicle anyway :unsure: . High risk....
