Hi everyone spread the message if you can please.

My mother has a ginger cat named Dawn. He has been with our family for 5 years since he was a rescue. Unfortunately some "animal lover" lodged a complaint against her about the cat. She lives in an apartment and the cat is indoors only so you can understand our frustration. My mother is in danger of loosing her house if she does not find a new home for him.

He has all his vaccines he has been sterilized and microchipped. He is very loveable and playful, loves his catnip like every good junky cat. He has all the good accessories fancy bed as well as massive scratch posts and lots of toys. A closed box cat litter to do his business in private without messing the house. He has been able to adapt easy with other cats in the past without being really aggressive unfortunately "Mayhem" his mentor had to be put down due to his epilepsy being extreme hard to control causing him to suffer a lot.

We are willing to cover all his food expenses for the first 3 months as well.

He has been my mothers company for the past 5 years as she lives alone and it is with a very heavy heart we are forced to do this. We hope we can find a new where he can be loved.

Wish something can be done.

Wish I could help, already have two cats who control our house.
Maybe worth opening the discussion about what the complaint is about? Surely it'll end in a happier ending for everyone involved? If the cat is kept indoors it isn't an issue?

For context I've been on the other end, being the complainer for an owner who left their cat out all day without being home. The cat was lonely and fought with our two cats. After talking to the owner multiple times and providing our point of view we came to a compromise and it all worked out.

If that's not an option I wish you guys the best of luck, can't be a nice position to be in.

Hi Mate thanks for your reply. The building has many pets all around. But a few years back just before my mother moved in they voted no more pets allowed. The issue at hand is that the agent failed to mention that in time. My mother has since bought the apartment. The issue with the neighbor is apparently he has a cat phobia. My mother has tried to accommodate this by adding dark net on the gate so it can keep the cat out of sight for him. Since she bought the apartment a few months she changed the gate with a reinforced one and hadn't replace the dark net on the gate. Hence the more complaints coming from the neighbors side. I think maybe like you said its worth another try talking to him. Although I am not sure if we can achieve anything more.

The ideal situation would be to figure out a way for Dawn to stay with my mother since she really needs the companionship as she has been through a rough patch after my Grandmothers passing.

If there's no mention of pets in the lease or body corp rules the threats are empty. It sounds like you've exhausted all avenues by talking to the neighbour, take it to a body corp meeting or something?

The lease agreement I will have a look at as it might be a tool to fight. Body Corp rules are clear no pets. Body Corp Chairperson is actually helping my mother trying to resolve this but her hands are tide at the same time by the rules.

I'd just get the animal registered as an emotional support animal, by hook or by crook if need be, and woe unto whoever tries to take said emotional support animal away from me. After all that time, surely that cats company means more to your mom than most can imagine. A pet becomes a literal part of a family unit IMO. There has to be some legal recourse surely, especially considering other units have pets, albeit from a period when the rule wasn't in effect. Your mom owns the unit and is not some second class tenant/renter 😁

And which sane person has a cat phobia anyways?! :eek: Your mom should open a case of stalking and get a restraning order from the obviously insane neighbor. Fight fire with fire I say. :LOL:

PS : Much of what I say is facetious - up to the reader to figure out which parts that apply to.

We are looking into it about the emotional support animal cause he truly is. And we will do it the legal way. Thanks for the support.

had a similar thing happen in my complex - they will need a 75% vote from all owners to try and enforce a no pets policy

i would suggest you read up on csos rules - the law changed in 2016 wrt to pets in complexes.
if you can give me more details i can try a help more

Does her lease specifically make mention of it, or list that you must comply with the body corporate rules that could change?
Were the rules made available before/after signing the lease from the agent?

I am not sure about the lease but I also need to check the contract she signed when se purchased the flat. The rules where before I think.
