Hi All

Firstly the original deal thread:

I just wanted to send out a warning and ask if anyone has any further info on this seller as I plan to go open a case against him after been given the run around, please see below my negative rating comment after a deal was first done:

"I would never deal with this guy again. I confirmed that all original packaging and accessories come with the advertised "brand new" phone. I was happy and made payment plus an extra R100 for postnet to postnet shipping. Still on good terms I was sent the tracking number and told him I would let him know when all arrives safely.

I received the package and when opening it up immediately found an old iPhone X box which sent the alarms ringing. Opening the box alas the iPhone XR was there trying to squeeze into the X box...no tray of course. Taking the phone out and found a dirty charger with a cable that once was white but turned brown from grease and who knows what else. There were set next to an old set of ear-pods that were just wrapped around themselves...like a pair would be in daily usage.

I immediately contacted the seller via pm on Carb and told him this is not what was advertised and confirmed as being sold to me. I told him I need the original box and accessories for resale purpose and to please send the items which would of come with the phone. This was on the Friday and on top of this when I turned on the phone I see it still had all the previous users (NOT THE SELLER) information and was locked to their icloud account!

No reply...so Saturday morning I send another message...no reply...Sunday I send another message...NO REPLY.

Monday I message again and tell them I will be taking this further as he has made a runner but of course I have all the info on the phone that wasn't wiped....finally a response with a whatsapp number and a promise of the correct box and accessories to be sent to me.

After back and forth on whats-app the seller eventually just gave up replying to me...and not answering my phone calls.

As the owner of the phones details were on the phone I called that number and after chasing that person for a a few days he finally gave me his icloud password so I could wipe the phone.

As I couldn't resell the phone or gift it as I originally planned to I guess I just have to keep it for myself.

Thanks for nothing. "

Due to the above I kept the phone and was using it fine until last Sunday when the signal just died, after taking it to the iStore for a possible warranty repair I was told to check with Telkom as it could be blacklisted, I did this and true enough it had been reported stolen and was blacklisted and nothing they could do to help me further.

I got in touch with the seller(s) and explained the situation to which I was told it was someone else's phone and then someone else's etc etc but he would sort it out and if he couldn't then I would be refunded.

After following up for any progress countless time last week it was decided I would get a refund.

It has now been over a week and as expected from the the time I was told I would get a refund there is total radio silence and I am getting no responses from read messages on whatsapp and no answering of my calls.

I am going to open a case against Zahir Motara (@Monty786 ) and the person who I believe he sold the phone on behalf of for selling stolen goods.

If anyone has anymore info from dealing with this person please let me know so I can put together a better case.

Thanks in advance.

If the phone is stolen he has just committed a crime of selling you stolen property.
Can Telkom not put you in contact with the person who's phone it originally was, as it is now recovered, or alternatively pass your details on to them?
The purpose of course is to return the phone and also get a case number of when it was originally reported stolen.

From there (case no.) you can contact the investigating officer and pass on the details of the seller to him/her.

Not overly surprised there has been no response.

Telkom would not give me the details or be of any help at all, even if I get an affidavit from the police.

I am getting the feeling that the phone has actually been stolen from Telkom though, as in the phone was got on contract and then that contract was defaulted on.... either way I still sit here 10k out of pocket....

pm me the number that was on the iphone - i might be able to help out. will let you know tomorrow

All sorted. For clarity - @durimotara is still the upstanding guy he always was. He's not related to this case at all. I just found something and wanted some info, thought it could help. Doubt it can.
