Help - Advice on Mastercar woes

I'm having a bit of a kak experience with VW. Any advice is welcomed

After months of saving money and searching for a car to spend it on (first own car purchase) I found a Mastercar that ticked all the boxes. A Polo GTI. They brought the car down for me to test drive and aside from a crack in the windscreen the car was awesome. The steering had quite a bit of vibration but as a sports car it didn't seem out of the norm and decided to go for it.

Got a quote, and everything was going well - I then mentioned I wanted to pay a bit of a big deposit, then got sent a revised quote and all of a sudden the car was more expensive. After back and forth fighting trying to understand why I now have to pay more for the same car they eventually offered me the original price but they will no longer install smash and grab for me as per the original quote. This was the first bump in the road but set on getting the car and the fact that the car already had previously installed smash and grab I went ahead.

Within a few days they replaced the windscreen, and prepared the car for collection - I drove through to collect i, got in and immediately when driving off I noticed the cars wheel alignment is way off. When hitting the brakes the wheel would visibly turn off to the left. Luckily I was still in the town so I went back to the dealership and brought the alignment to their attention but nothing came of it. Eventually I took it for alignment, rotation and balancing on my own account - drove off and the car still pulled left. Took it back and they switched the two front wheels and same issue persists. They said it has to be the tyres. I contacted the dealership explaining the least they could do is help with the bill for new tyres since the car isn't even a month old and I brought this to their attention before.

They weren't too happy but asked me to take the car for a second opinion to their requested shop, BestDrive - After inspecting the car and confirming the strong pulling to the left he wrote VW directly in email saying the tyres are fine but he suspects the previous owner or VW has knocked into a curb/pothole because the caster readings are out of spec and these vehicles don't have adjustable casters - and that it would have to be taken to a body shop to be straightened. VW gave me a call a few days later saying it's just an alignment issue they'll come fetch the car and have it aligned. They fetched the car, took it to be aligned and brought it back. I drove it around town and the steering is still off. I called the BestDrive they took it to and couldn't seem to get out to the technician to ask what was wrong with the vehicle.

Tired of running up and down at this point and suspecting I've been sold a car that knocked something I decided to take it to Dekra for a technical inspection - nothing major wrong with the car but they found that the car has a deformed rim on the same side of the car where the caster was out of spec. So based on this I was pretty bummed, paying for a car that doesn't drive straight and now suspected to have been knocked hard enough to throw the alignment out and buckle the rim. I've currently had the car for 2 months and 1 day. The issue has been there since day one and I've brought it to their attention. They want me to wait till sometime next year to sort the car out but I lost faith in the car.

After consulting with someone who happened to work with this manager I've been dealing with I was told I would be within my rights to return the car within 6 months but the manager I've been speaking to at VW is making it sound like an impossible task. So I enquired on what the trade in would be and considered taking a loss and just buying a new car but he offered -R110 000 less than the original price of the car two months ago.

At this point I don't know what my options are, should I just give up and keep the car?

Section 56 of the Consumer Protection Act is on your side. It seems you communicated the defect to the dealer and the dealer has attempted to fix the issue without success. The goods are therefore still defective and you are empowered to return the vehicle to the dealer for a refund. Read here:

"(2) Within six months after the delivery of any goods to a consumer, the consumer may return the goods to the supplier, without penalty and at the supplier's risk and expense, if the goods fail to satisfy the requirements and standards contemplated in section 55, and the supplier must, at the direction of the consumer, either-
(a) repair or replace the failed, unsafe or defective goods; or
(b) refund to the consumer the price paid by the consumer, for the goods.
(3) If a supplier repairs any particular goods or any component of any such goods, and within three months after that repair, the failure, defect or unsafe feature has not been remedied, or a further failure, defect or unsafe feature is discovered, the supplier must-
(a) replace the goods; or
(b) refund to the consumer the price paid by the consumer for the goods."

Try this route first. If they still refuse to comply, formally declare a dispute in a letter to them and in the same letter, refer the dispute to the Motor Industry Ombudsman.

This is not legal advice and if you are unsure, you should speak to an attorney about this issue.
 
I think (bit am not 100% sure) that you might have to go via the motor industry ombudsman for this. Some businesses motivated for their own channels for disputes. I can't remember if this cancels out the option of going the consumer commission route though.

 
Have you sorted out this problem yet? If not, include VW SA in all your communications to the dealer.
