Bad deal with @BeanBud who sold me an X3 M40i

Description of Bad Deal:

I purchased a BMW X3 M40i from @BeanBud and his father (however I spoke to the father after purchasing the vehicle, I will refer to him as @BeanBud ) on 21st of January 2022, he had all documents which he did stated in the ad, however before purchasing the vehicle, I asked him if the car was fully paid for and he stated that the vehicle was paid in full in cash.

I then resold the vehicle to another customer from the dealership (Autohaus Beyers) which he sold the vehicle to.

A month passed and I received a phone call from BMW Supertech in Durban who asked if the stated dealership double finances vehicles. The owner of BMW then stated that the X3 I bought was still on finance and was not paid for and installments were not being paid.

BMW then stated that they shipped @BeanBud the vehicles papers by mistake when the vehicle was bought and they contacted him to send the documents back. They however did not send the documents back to BMW and sold the vehicle to me. I then contacted @BeanBud to ask what is happening because he stated that the vehicle was paid for.

He then tried to avoid speaking to me and said that he is in contact with the owner of BMW Supertech and he will get back to me, however when I asked the owner if he has been in contact with @BeanBud he denied it.

Many phone calls were made to @BeanBud to sort out the situation and he kept on making false promises to pay the money he owes to BMW Supertech.

Today the sheriff collected the BMW from the current owners who the vehicle was resold to. I then contacted @BeanBud to notify him that they are going to lock him up for selling a vehicle which was not paid for. He then stated "It is what it is".

This is the current situation as of today 22 April 2022.

This bad deal is going the legal therefore no longer applies here on Carbonite.

@BeanBud, will however be banned. Users take responsibility for all deals taking place on here. And this is in breach of our rules.

Please could you give me a chance to further explain how some of the things Uzair has said were untrue. I have valid proof and a further explanation.

I think a negative/red iTrader is more suitable as nobody got scammed. Uzair and their dealership still have their money and the vehicle is 100% not attached by a sheriff.

If the outcome somehow proves that I am guilty then it is totally understandable for me to take the ban. It is very unfair to get banned on the premise that I supposedly scammed someone. This is blatant slander from Uzair.

Like I said before, I'm a really trusted person on Carbonite and I only mean well (As you can clearly see from my iTraders with PC parts). I have no intention of dealing in cars ever again. Please, put yourself in my shoes...would you have known that there were problems? Had I known, then I simply wouldn't have facilitated the deal. If I was a scammer I'd be running very far away which I not neither is my father. My dad simply chose not to answer their calls because all they do is curse without proposing any type of realistic solution.

If we come to an agreement to repay the money back, then we'd be paying R1m to Autohaus and almost R30k a month to the original finance company - again I'd like to reiterate that the vehicle is not with sheriffs and Autohaus/Uzair refuses to send a copy of the letter from the sheriffs office stating that the vehicle was attached. Essentially we'd end up losing R2.4m without even getting the vehicle back!

Also to invalidate his claim about my father not being in contact with BMW Supertech, I have all the call logs where my father spoke to Supertech and the owners for over 17 minutes.

If you need proof of anything then I don't mind sending over anything you'd need.

I hope this puts things in perspective

@Uzair_12 has Autohaus been paid by WesBank for the 2nd finance agreement or were you requested to return the money as per Autohaus's recourse agreement?
 
We have to refund wesbank the money paid to us for the X3 and the car has been taken away from the new owner.
 
@BeanBud @Uzair_12 from what I can gather via this thread and PM's. The issue is now in the legal system.
I will appreciate updates on it via PM, once you both have a verdict and proof of resolution. This bad deal will be resolved.
