And before you try and tell me how this isnt possible you need to know that if a guy comes into your house while breaking in and hurts himself he can sue you for that as well.

Oh bullshit fear mongering, that doesn't even successfully happen in the USA where people sue for everything including their coffee being too hot. Just because he can ATTEMPT to sue you doesn't mean he will win. I can try to sue someone for being ugly, it will get thrown out.
 
Question for those with a bit of legal knowledge: when the criminal case is opened at the police station, does one forfeit the right to open a civil case at the small claims court? Can he be arrested AND still be forced to repay the money?

The two are independent - eg you can lose the criminal case and win the civil case.

Busy with an investigation at the moment where 2 staff were involved and lost there jobs and have started an elaborate scheme to sue due to financial losses and all they achieved was an admission in a court that they did infact commit a crime.. 😃

I'd try get his boss arrange a meeting so that Jack_Bauer_ZA can be in the room when they ask him what's his story. Then we can get a nice report of how he shits himself. I wouldn't worry about a suit, he's more in the wrong and I'm pretty sure really doesn't have the money to go to court anyway.

This is a country where if a robber gets hurt IN YOUR HOUSE you can get sued.

PS: And I'm talking about a case where the courts ruled in favour of the perpetrator, not just a news article where someone sued for something like this. I can sue Uncle Jack for being too sexy but it doesn't mean I'll win. Perhaps that's a shitty example, because I probably will, but still.
 
There are several SEVERAL cases of these silly sort of court cases. I made it clear you can get SUED for it. IF the case gets thrown out or not . YOu still need to go to court and pay for representation costing you anywhere from 2k - 15 K . Still leaving you with a loss. I have a friend who sued a company where he went around Kyalami in a race car. The car too ka turn and he hit his head somewhere ( roll cage ., side panel , his own hand , Who knows ) the bottom line is that he had a shiner of note after the car stopped. No matter how strong their " in case of injury we are not liable Bs " They ended up settling 2 days later paying him R5000 for the damages as going to court would've cost both of them more funds, My fiance had to represent a company where the employee who got fired for poor performance took them to the ccma first then a direct suit against the company for damages. IT came down to him getting anxiety after they let him go and this led to him struggling to find work and a loss of income. he didn't win the fight but It cost that company about R25 000 in legal fees to get it thrown out.

Bottom line is people do silly things when desperate and in this scenario its good to just keep your side clean. No matter how you look at it you being a good person will still come of 2nd best here if he does end up loosing his job. Will you feel better knowing its your fault his wife, Son , Daughter , Dog , cat etc cant be fed because you called his boss? I highly doubt this.
 
By the same token it will cost him R2k to R15k to get representation to sue you and if he is scamming people for small amount of money i douht he would have the cash to try sue

I never get involved in these posts but your point doesn't make sense to me, so you are are saying the scammed must sit back and take what they have been dealt because some dick decided to help himself to your funds or equipment, that we should take cognisense of what retaliation would so to him or his family (wife and kids)... where is the sense of justice for the scammed.... i would pay 50k for a 5k product so number 1 people will know i wont sit back and be taken for a ride and number 2 as many people that know him INCLUDING his family know just how much of a scumbag he is and i would sleep like a baby doing it

I don't see a case where someone sued a homeowner after breaking in and hurting himself though.

I get what you're saying, and I think I come across as a bit harsh. Apologies, it wasn't my tone. I'm very interested in "silly" court cases and the law though (not that I have any professional knowledge of it of any kind), and the deduction I make time after time is that people are being fooled by rumours regarding all kinds of laws and they take rumours as truth. That HURTS the lawful citizens beyond measure, and should be stopped.

Oh, and the first thing I would have done is contact the guy's job. I got a dude fired who posted some of the most racist crap publicly and I'm still proud, imagine what I'll do to a guy who steals from me and I know where/what/who he is. Fuck him.

I'd feel better. Sorry, but I just will. The wife should leave the stupid bastard. And remember, all that's necessary for evil to triumph is for good people to do nothing.

Don't as a first move go and tell his Boss about his extra mural activities, work the scammer with the knowledge you have of his situation.

Look I get what you are saying, but I will paraphrase one of the Best Regional Court Magistrates in the country may he rest in peace. When pleading mitigation of sentence his attorney made your argument, and all he had to say was he should have thought about his family etc when he was doing the crime.

your friend jumped in a car to go around a race track, bumped his head and sued the guys for that? Like he didn't break anything, he just had a bruise? Is he american?
 
so,,,, he skipped town, sold everything after getting fired and ran, also got a hold of his rap sheet this week, and uhm its like a GTA sequel im watching with this oke..... bad part is I sat next to him at work and didn't suspect a thing for almost a year,
 
I got the news too. I'm a bit miffed with the cops, since they were supposed to go get him this last Thursday. Well, I guess that's that then. Learned a few lessons along the way as well.
