Advice on Traffic Fine

Hey guys, hoping someone out here can shed some light on this.

So i receive a notification from PayCity of a new fine on my name...A whopping R1500.00, FOR WHAT? I had no idea.

Logged onto the site to view more details, where it says that the fine was issued for failing to stop at a stop sign...
Fair enough right.., but... the only thing is, i was never pulled over and issued with a fine...

So my question to any learned person out there is... is it lawfull to be issued with a fine of this nature without physically being issued with the infringement at the time of the incident?

I honestly have no recollection of the incident, and I'm wondering how this can proven by myself, or the issuing authority?
 
As far as my brother in law (advocate) is concerned if they did not confirm it was you don't pay it.

This is not legal advise though use at own discretion.

Ask for the fine where you signed, a photo (of you not stopping). Surely they can't send a find with no verification that it is you

No yellow line
No red line
No carriage way crossing
No fire hydrant
No signs
Fokall

But some guy phoned and said I was interrupting traffic flow on his street so a traffic cop came and gave me a fine.
Have you seen Cape Town streets, they are super narrow with legal parking on both sides.

30min later there was 3 delivery vans/trucks illegaly parked with their wheels on the pavement on the exact same spot.
I have photo evidence.


Whois the bigger C8NT in this situation, the guy that phoned or the traffic cop........

I will never pay that fine
 
Wait for a Summons....
a fine is not a Summons.
Usually in these instances they are supposed to spot fine you not send you one in the post.

In my younger days when I got speeding tickets I used to request:
Officers name
Competency Certificates
Renewal Certificates
Make of the Speed Trap
Maintenance Logs
Name of Agents in SA
Copies of the service logs

8 out of 10 times they would withdraw it.

@Nickslayer that is definitely not legal advice. Constitutional Court confirmed that reverse onus is acceptable in cases traffic court ie if your vehicle is involved in a traffic offense it is assumed you are the driver unless otherwise proven. I think what he meant is if they have not handed you the summons personally they cannot issue a warrant for your arrest.

Thank god we all have cameras in our pockets nowadays. Its your best weapon against these Jackbooted Criminals in uniform.

I have the email address you send a msg too, to ask for a discount and explain why etc.

Do they have a picture of your car, in the fine? If so, the evidence is there and as mentioned before, it is taken that you were the driver.

With all the mails I’ve sent, my fine was halved.

If you feel that you are not at fault, you can use the below mail and state that as well.

Send a mail to:
Traffic.Representation@capetown.gov.za
In subject: Att: Traffic Manager, &“Fine Number”

So I've had two cases whereby I was fined and asked for a reduction or for it to be removed.

The only time they didn't reduce it is when there is a court date (old plates on my car when I took ownership of the car) and they said that it's an immediate either pay or appear before a magistrate court.

I would look at what they require to issue the fine eg evidence as has been stated and then send them an email explaining why the fine is nullifiable when they can't give it to you.
I would ask for it to be escalated as blatant maladministration or corruption (don't say that it IS corruption or maladministration, just say that it's likely given X, Y and Z circumstances surrounding the fine).
I'd also report it to the corruption hotline if they push back.

I was fined for not stopping at a stop street, even though I did. I was young and scared and just paid the R500 fine. I should have asked for the cops details and to be taken to the nearest police station to lay an official statement. It's within everyone constitutional rights.

There's a video of a guy driving with a dash cam recording and he stops at a stop street, turns the corner and a cop pulls him over and states that he didn't stop. I couldn't find it now but I'll look for it later on.

Dash cams are looking like a basic requirement.
 
In this scenario, I don’t see how a photo of the vehicle is proof that he didn’t stop? A person can stop and the metro take a picture as the driver starts moving again. Speed trap is a different story.

IMO I feel the metro should’ve pulled you over to fine you on the spot to make it legal.
